1. ACCEPTANCE OF TERMS

Welcome to the Expense Tracker. Comtrack provides its service to you, subject to the following Terms of Service ("TOS"), which may be updated by us from time to time without notice to you.

2. DESCRIPTION OF SERVICE

Comtrack currently provides users with access to a personal expense tracker which allows any user to manage his/her expenses online and at no cost. Unless explicitly stated otherwise, any new features that  enhance the current Service, shall be subject to the TOS.

In order to use the Service, you must obtain access to the World Wide Web, either directly or through devices that access web-based content, and pay any service fees associated with such access. In addition, you must provide all equipment necessary to make such connection to the World Wide Web, including a computer and modem or other access device.

3. COMTRACK PRIVACY POLICY

Account Data and certain other information about you are subject to our Privacy Policy. We   believe that your personal information belongs to you. We collect this type of information when you provide it, but we do not currently rent or sell information concerning our customers to third parties.

4. MEMBER ACCOUNT, PASSWORD AND SECURITY

You are responsible for maintaining the confidentiality of the UserID and password you choose when you create your account, and are fully responsible for all activities that occur under your account. You agree to (a) immediately notify Comtrack of any unauthorized use of your password, and (b) ensure that you exit from your account at the end of each session. Comtrack cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 4.

5. NO RESALE OF SERVICE

You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service.

6. MODIFICATIONS TO SERVICE

Comtrack reserves the right at any time  to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Comtrack shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

7. COMTRACK'S PROPRIETARY RIGHTS

You acknowledge and agree that the Service contain proprietary and confidential information that is protected by applicable intellectual property and other laws. Except as expressly authorized by Comtrack, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service, in whole or in part.

8. DISCLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

a. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. COMTRACK EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND.
b. COMTRACK MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS AND (ii) THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

9. LIMITATION OF LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT COMTRACK SHALL NOT BE LIABLE FOR ANY DIRECT OR INDIRECT DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE LOSSES, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE.
